1 About these Terms
These Terms and Conditions ("Terms") govern your access to and use of the ZSchool Data platform and related services ("the Service") provided by Amenity Technologies and General Dealers, a business registered in the Republic of Zambia (TPIN 1011635479), with offices at 120001, Kasempa Boma, Kasempa District, Northwestern Province, Zambia ("we", "us", "our").
By creating an account, subscribing to a plan, or otherwise using the Service, you ("the User", "you") agree to these Terms. If you do not agree, please do not use the Service.
2 The Service
ZSchool Data is a web-based platform that helps teachers in Zambia generate professional, curriculum-aligned teaching materials using artificial intelligence. The Service includes, but is not limited to:
- AI-generated lesson plans aligned with the Zambian Competence-Based Curriculum (CBC)
- AI-generated schemes of work organised by term and grade
- AI-generated lesson notes for classroom use
- Storage, editing, and downloading of generated content in PDF and Word format
- Account management, subscription handling, and related administrative tools
3 Who can use the Service
The Service is intended for:
- Qualified teachers, head teachers, and education professionals employed by a registered school in Zambia
- Independent or private teachers who deliver lessons in Zambia
- Administrators acting on behalf of a registered school
You must be at least 18 years old and have the legal capacity to enter into a binding contract. You must provide accurate, current, and complete information when registering an account, and keep that information up to date.
4 Accounts
4.1 Account creation
School-based teachers are registered by their school administrator and receive login credentials via that channel. Individual teachers may self-register on the platform. Each User is responsible for keeping their login credentials confidential and is fully responsible for all activity that occurs under their account.
4.2 One account per teacher
Accounts are personal and may not be shared, transferred, sold, or used by more than one person. We reserve the right to suspend accounts where we reasonably suspect credential sharing.
4.3 Suspension and termination
We may suspend or terminate your account, with or without notice, if:
- You breach these Terms;
- We reasonably suspect fraudulent payment activity, account sharing, or abuse;
- You use the Service to generate content that is unlawful, harmful, or harassing;
- You attempt to gain unauthorised access to the Service or interfere with its operation; or
- We are required to do so by law.
5 Subscriptions, free trial & payment
5.1 Free trial
New Users receive limited free generations to evaluate the Service: typically one (1) lesson plan and one (1) scheme of work. The free trial is offered as-is, with no obligation to subscribe.
5.2 Subscription plans
Paid subscriptions unlock higher usage limits for each service (Lesson Plans, Schemes of Work). Available plans, their durations, and current prices are displayed on the platform's subscription page. Subscriptions are billed in Zambian Kwacha (ZMW). Prices may change from time to time; changes apply only to new purchases, not to active subscriptions you have already paid for.
5.3 No automatic renewal
5.4 Payment processing
Payments are processed through third-party payment service providers, including DPO Pay and mobile money operators (Airtel Money, MTN Mobile Money). We do not store your card numbers, CVV codes, or mobile money PINs on our servers. By making a payment, you also agree to the terms of the relevant payment provider.
5.5 Failed or pending payments
If a payment fails or remains pending, the corresponding subscription will not activate. If you have completed a payment but your subscription has not activated within one (1) hour, please contact us with your transaction reference and we will investigate.
6 Acceptable use
You agree NOT to:
- Use the Service for any unlawful purpose or in violation of Zambian law;
- Generate content that is defamatory, obscene, harassing, discriminatory, or that promotes violence or hatred;
- Use the Service to create content for examinations or assessments in a way that violates academic integrity rules;
- Resell, sublicense, or commercially redistribute Service output without our prior written consent;
- Attempt to reverse-engineer, scrape, or extract our prompts, models, or underlying systems;
- Use automated tools, bots, or scripts to generate content beyond your subscription's usage limits;
- Upload or transmit viruses, malware, or any other harmful code;
- Impersonate another person or misrepresent your affiliation with any school or institution.
7 Ownership of generated content
Subject to your continued compliance with these Terms, you own the lesson plans, schemes of work, and lesson notes that you generate using the Service. You may edit, print, share, and use them for classroom and professional purposes without restriction.
We retain ownership of the platform itself, the AI prompts, the underlying syllabus database, the user interface, and all related intellectual property. You may not copy, reproduce, or redistribute the platform or its components.
8 Third-party AI providers
The Service uses third-party AI providers (currently Anthropic Claude and OpenAI) to generate content. Your inputs (such as topic names, subject, grade level) are transmitted to these providers solely for the purpose of generating your requested output. We do not sell your data to these providers. Each provider has its own privacy policy, and we make commercially reasonable efforts to use providers with strong data-handling practices.
9 Service availability
We strive to keep the Service available 24 hours a day, 7 days a week, but we do not guarantee uninterrupted availability. The Service may be unavailable due to:
- Scheduled maintenance (we will give reasonable notice where possible);
- Emergency repairs;
- Internet, hosting, or third-party AI provider outages;
- Force majeure events (power outages, natural disasters, etc.).
Brief outages do not entitle you to a refund. Extended outages (more than 48 consecutive hours of full unavailability) may, at our discretion, entitle you to an extension of your subscription period equal to the outage duration.
10 Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties, express or implied, regarding:
- The accuracy, completeness, or curriculum alignment of any specific AI-generated content;
- The Service's fitness for any particular educational purpose;
- Continuous, error-free, or uninterrupted operation;
- The accuracy of any third-party content referenced in generated material.
AI-generated content must be reviewed by a qualified teacher before classroom use. You bear full responsibility for the use of any output in your classroom and for compliance with Ministry of Education and Examinations Council of Zambia (ECZ) requirements.
11 Limitation of liability
To the maximum extent permitted by Zambian law, our total liability to you for any claim arising out of or in connection with these Terms or the Service is limited to the total amount you have paid us in the twelve (12) months preceding the event giving rise to the claim.
We will not be liable for:
- Loss of profits, revenue, business, or anticipated savings;
- Loss of data (you are responsible for downloading and backing up content you wish to keep);
- Indirect, incidental, special, or consequential damages;
- Any educational outcome or assessment result arising from the use of generated content.
12 Changes to these Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify active subscribers by email or via a notice on the platform. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13 Governing law & disputes
These Terms are governed by and construed in accordance with the laws of the Republic of Zambia. Any dispute arising out of or in connection with these Terms shall first be referred to good-faith negotiation. If the dispute is not resolved within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts of Zambia.
